The NJ Statute is derived from the Federal ''Racketeer Influenced and Corrupt Organizations' (RICO) Statute, but the NJ charge is broader in scope then the federal charge. The key elements of this crime are the alleged 'Enterprise' and 'Pattern of Racketeering Activity'. Among many types of crimes, Racketeering Activity includes Murder, Kidnapping, Gambling, Drug Trafficking, and Human Trafficking.

Wiretapping and Electronic Surveillance

The prosecution will frequently use Wiretapping or other types of Electronic Surveillance to build their Racketeering case. Our lawyers understand how complex these types of investigative techniques can be, and how persuasive they can be to a jury. We also understand how Electronic Surveillance can be attacked by contesting: the alleged basis for the use of this technique, how the State conducted the interceptions, what portions of the communications were subject to being minimized, how the participants in the communication were identified, and how the words, terms and phrases used in the seized communications are being interpreted by the prosecution.

A Racketeering Enterprise; and, A Pattern of Racketeering Activity

Under the NJ statute, all the State needs to establish is that a loosely associated group of people, had a common purpose to commit two predicate acts constituting a pattern of activity on behalf of the enterprise. There is no requirement that each person be personally involved in each act. It is sufficient that the person agreed that another member would commit the acts on behalf of the enterprise.

Consequences and Penalties of Conviction
