The 'Bribery and Public Corruption' crimes in the N.J. Criminal Code serve to punish both the 'Public Official' who accepts the 'benefit' which was offered to 'influence' or bribe the official's behavior in their public capacity; and, the person who is offering the 'benefit' to bribe or otherwise influence the 'public official'.
The statute make it clear that the term 'Public Official' includes all government employees, and any person holding either an elective or appointed office of a political party. This includes but is not limited to: Judges, Legislators, Jurors, Voters, and Consultants performing a governmental function. The crime includes bribes that are intended to influence ministerial as well as decision-making actions by the 'public official'.
Bribery by Offering or Accepting a Benefit
The statute makes no distinction between a bribe of money vs. a bribe of something else other then money. The bribe must be offered or accepted as consideration (payment) for the actions of the 'public official'.

Prohibited Conduct the State Can Try to Prove Was Bribed- The decision-making, the giving of an official opinion or recommendation, and the vote for or against something by a public servant.
- The decision, vote or exercise of official discretion in a judicial or administrative proceeding.
- A violation of an official duty by a public servant or a party official.
- The violation or mis-performance of Official duties by a 'public official'
