State of New Jersey v. RS

Outcome: Adult Bookstore - Charges Dismissed and Still in Business

Description: Client was involved in the operation of an established 'Adult Book Store' that the county prosecutor decided he wanted to close under a 'quality of life' initiative. In essence, the client and others persons were charged with criminal violations for having too many signs indicating the nature of the store. The State refused to allow the client to enter the PTI program; and instead decided to make an example of the client under the so-called 'quality-of-life' initiative. The State then offered the client a plea that exposed the client to a State Prison sentence. We counseled the client to reject the plea, and to fight the case. After Motion practice and numerous Court appearances, all charges were dismissed and the store remained in business at the same location with all of the signage it had at the beginning of the case.
