State of New Jersey v. VC

Outcome: 2nd Degree Possession of a Handgun Charge - No-Plea PTI

Description: Client (who did not reside in NJ) was driving through NJ, and had in their possession a handgun the client legally owned in their home State. The police charged client with the 2nd degree Possession of a Weapon (gun) charge. If convicted after trial or plea, the client would have been sentenced to a State Prison for at least 3 years (parole ineligible). Based on successful defense arguments, the Prosecutor agreed to divert the client into the Pre-trial Intervention (PTI) program, for a six month period. (Note: this is the only gun possession case in the State of New Jersey that the N.J. Attorney General has agreed to divert this way since the law was amended in early 2008). Significantly, since no plea was required, the client can get this expunged in six months after they complete the PTI diversion.
