State of New Jersey v. AP

Outcome: 1st Degree Leader of Drug Trafficking Network Reduced to 3rd Degree, with time served sentence; and, No Deportation

Description: The client (who was not a US citizen) was charged in a multiple-defendant case with numerous charges, most importantly with being a Leader of a Narcotic Trafficking Network. This crime alone exposed the client to a sentence of Life with 25 years of parole ineligibility; and, then automatic deportation. The principal evidence against the client was a wiretap used to seize the client's phone calls. Based upon legal arguments during Motion practice, we convinced the State to offer the Client a plea to 3rd degree Money Laundering, with all other charges being dismissed. The plea allowed the client to be released immediately with a sentence recommendation of time-served. The plea also allowed the client to remain in the US, as it did not constitute grounds for automatic deportation.
